This document is an electronic record in terms of the Information Technology Act, 2000 and the rules thereunder, as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of the domain name silvy.onrender.com ("Website"), including the related mobile site and/or mobile application (hereinafter referred to as the "Platform").

The Platform is owned and operated by SilvyOS, a company incorporated under the Companies Act, 1956, with its registered office at 1797, Bilaspur Torwa Dhan Mandi, Bilaspur, India (hereinafter referred to as "Platform Owner", "we", "us", or "our").

By using or accessing the Platform and our Services, you agree to be bound by these Terms & Conditions ("Terms of Use"), along with our applicable policies including the Refund & Cancellation Policy, Payment Policy, and Privacy Policy, which are incorporated herein by reference.

1. Definitions

  • “You”, “Your”, “User” means any natural or legal person who uses, browses, or avails services from the Platform.
  • “Services” refers to IT services provided by SilvyOS including but not limited to website development, Android/iOS app development, software solutions, maintenance, hosting, and related digital products.

2. Use of Services

  • You agree to provide true, accurate, and complete information during registration and project engagement, and you are solely responsible for all activities under your account.
  • Your use of the Platform and Services is at your own risk and discretion. You are responsible for ensuring that our Services meet your requirements before engaging us.
  • You agree not to use our Platform or Services for any unlawful, illegal, or unauthorized purposes under applicable Indian or local laws.

3. Intellectual Property

  • All intellectual property rights in the Platform, including but not limited to designs, layouts, source code, software, graphics, and other content, are the property of SilvyOS.
  • Project deliverables (including source code, designs, and documentation) shall remain the property of SilvyOS until full payment is received. Upon full and final payment, rights will transfer to you as per the agreed service contract.
  • Unauthorized use of any part of our Platform or Services may give rise to legal action.

4. Payments & Refunds

  • All payments made for Services are subject to our Payment Policy.
  • Projects require an advance payment before commencement, and the remaining balance must be cleared prior to delivery or launch.
  • All payments are strictly non-refundable, as detailed in our Refund & Cancellation Policy.

5. Project Delivery & Support

  • Project timelines are indicative and depend on your timely cooperation, including providing required content, approvals, and feedback.
  • After delivery, SilvyOS provides free edits and adjustments for 3 months from the date of delivery. Beyond this period, edits, modifications, or upgrades will be subject to additional charges.
  • Third-party integrations, APIs, plugins, or licenses used in your project are governed by their respective providers’ policies and are non-refundable.

6. Limitation of Liability

  • SilvyOS shall not be liable for any indirect, incidental, or consequential damages including but not limited to business loss, revenue loss, downtime, or data loss arising out of the use of our Services.
  • We do not provide any warranties or guarantees as to the accuracy, completeness, or performance of third-party tools, plugins, or services used in your project.

7. Indemnity

You agree to indemnify and hold harmless SilvyOS, its affiliates, employees, and partners from any claim, loss, or liability (including reasonable attorney’s fees) arising from your breach of these Terms, violation of laws, or infringement of third-party rights.

8. Force Majeure

SilvyOS shall not be held liable for delays or failure in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, internet outages, strikes, acts of government, or force majeure events.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Bilaspur, Chhattisgarh.
